NIST 800-53 PS-8 Personnel Sanctions: A Short Evidence Guide

PS-8 expects a formal sanctions process for people who break security and privacy policy. Here is what it requires and what evidence to keep.

A policy with no consequence is a suggestion. PS-8 Personnel Sanctions asks for a formal process for people who fail to follow information security and privacy policies. NIST 800-53 binds US federal systems, and others by contract. For most companies it is a reference for what an auditor may ask about.

What it means in practice

Two things are required. Employ a formal sanctions process for individuals who fail to comply. And notify defined personnel or roles within a defined time period when a sanctions process starts, naming the individual and the reason.

The guidance says sanctions are described in access agreements and may sit in general personnel policy or in the security and privacy policies. It also says organizations consult legal counsel about employee sanctions. That matters: the process is an HR and legal process, not an IT one.

Evidence to collect

  • The sanctions section of your policy, with the range of outcomes.
  • The reference in your access agreement that points to it.
  • The notification rule, naming who is told and how fast.
  • Anonymized records that the process has been used, if it has. If it has never been used, say so.

Common gaps

  • The policy says violations may lead to discipline, but there is no process behind it.
  • Security does not know when HR opens a case.
  • Nobody wrote down the notification step.

How to implement it

Add a short sanctions section to your acceptable use agreement. Define the steps: report, review, decision, notification. Name the HR and legal owners and agree on the notification list with them. Keep records in HR, with a count of cases you can share without personal detail.

Quick check

Does PS-8 mean we must fire people for policy violations?

No. It requires a formal process. The outcomes, from coaching to termination, are your decision with legal advice.
