Can you use CC BY-NC assets in a commercial app?

Usually not. CC BY-NC bars uses primarily aimed at commercial advantage or money. Here is how to judge your case, and what to do instead of guessing.

Usually not. CC BY-NC does not permit use for commercial purposes, which Creative Commons defines as use primarily intended for commercial advantage or monetary compensation. A paid app, an ad supported app, or a product that markets your company is likely to fall inside that. Get permission or pick a different asset.

This is general information, not legal advice.

Definition: what NC means

The Attribution NonCommercial 4.0 deed says you may not use the material for commercial purposes. It defines a commercial use as one primarily intended for commercial advantage or monetary compensation. The deed points to the Creative Commons FAQ for more guidance on borderline cases.

The key word is "primarily". Intent and context matter, which makes NC hard to apply with confidence inside a company.

Common cases, and how to read them

SituationRisk reading
Paid app with an NC icon packLikely commercial
Free app with ads or in app purchasesLikely commercial, since money is part of the purpose
Free app from a company that sells other productsJudgment call; the deed's test is the primary intent
Internal prototype that never shipsLower risk, but track it so it does not ship by accident
Personal hobby projectThe use the license is aimed at

These are readings, not rulings. When the answer depends on judgment, treat it as not allowed unless counsel says otherwise.

Attribution still applies

NC licenses in this family also carry the attribution condition. If your use qualifies, you must still credit the creator, link the license and note changes, as with other BY licenses.

What to do instead

  1. Search for the same style under a license that allows commercial use, such as CC BY or CC0.
  2. Ask the creator for a commercial license. Get any yes in writing.
  3. Commission or draw replacements for assets that matter.
  4. Keep the register of every asset with its license so NC items are visible before release.
  5. Add a release check that fails if an NC asset is in the shipping bundle.

Why prototypes cause the trouble

Most NC problems start in design mockups. A designer drops in a convenient NC illustration, the mockup becomes the product, and nobody rechecks the license. A short asset register and a pre release check catch this.

Try it yourself

The gate demo shows a check that blocks a change until it passes. Click through it and think of a rule that would block an NC asset from shipping.

Safeguard's policies, gates and guardrails can block a pull request on conditions you define, and its SBOM and dependency scanning cover packaged assets. A free scan is available at gold.safeguard.sh/scan.

Quick check

Is a free app with ads commercial under CC BY-NC?

Likely yes, because ads aim at monetary compensation. Treat it as commercial unless counsel advises otherwise.

Can I use an NC asset if I credit the creator?

No. Credit does not unlock commercial use. Permission from the creator or a different license does.

Where do I read the exact definition?

In the Attribution NonCommercial 4.0 deed and the Creative Commons FAQ.
