Does an on-prem LLM solve data residency? What it does and does not

An on-prem LLM keeps prompts on your hardware, which helps data residency, but logs, embeddings and access still need controls. How to think it through.

Running an LLM on your own hardware keeps prompts and outputs inside systems you control, which makes data residency easier to show. It does not finish the job. Logs, vector stores, backups and who can query the model all still carry data, and the legal question depends on where people and data sit. This is general information, not legal advice.

What is data residency, and what is a transfer?

Residency is about where data is stored and processed. Law often cares about something slightly different: transfers. Under the GDPR, Article 44 says transfers of personal data to a third country or international organisation are allowed only if the conditions in that chapter are met. The same chapter provides routes such as adequacy decisions (Article 45), appropriate safeguards (Article 46) and derogations for specific situations (Article 49).

So the first question is not "cloud or on-prem". It is "does personal data leave a jurisdiction, and on what basis". A cloud model hosted in your own region, under a contract that fits one of those routes, can meet the rule. An on-prem model removes the question for the data that never leaves.

What does on-prem fix?

  • Prompts and responses stay on machines you control.
  • You choose the region, the retention and the network path.
  • You can run the model with no outbound connection, which helps in regulated or air-gapped settings.

What does it not fix?

Everything around the model still holds data. Prompt logs, evaluation sets, retrieval indexes and embeddings can contain personal or confidential data. Treat them like a database.

Access control still matters. OWASP's sensitive information disclosure entry lists least privilege, sanitization of data before it reaches the model, and restricting access to external data sources. It also warns that instructions in a system prompt about what data to return are not reliable on their own, since they can be bypassed. Enforce access in the systems behind the model.

Updates and support. A local model needs patching, capacity planning and monitoring. Staffing that is easy to underestimate.

Quality and cost. A smaller local model may do some jobs worse than a hosted one. Test against your own tasks before you commit.

How does this apply to security tooling?

Source code and findings are sensitive. Safeguard supports Zero AI mode, where the platform works without any model, and a bring your own model option that can include on-prem and local models. The local runner pulls a repository onto your machine, scans it there, and pushes only encrypted results. Together those let a team choose where code is read and which model, if any, sees it. Confirm your own legal position with counsel.

What to do

  1. Map every place prompts, outputs, logs and embeddings are stored and who can read them.
  2. Mark which flows contain personal data and where the people are.
  3. For each flow that crosses a border, write down the transfer basis.
  4. Decide per workload: on-prem, regional hosted, or no model at all.
  5. Set retention and deletion rules for prompt logs.
  6. Enforce permissions in the retrieval layer, not in the prompt.
  7. Re-test model quality on your own tasks after any move.

Quick check

Does an on-prem LLM make us GDPR compliant?

No. It removes some transfer questions. You still need a lawful basis, access control, retention rules and protection for logs and indexes.

Is a hosted model in my own region acceptable?

It can be, if the contract and the transfer basis fit the rules. Check with counsel for your case.
